The European Commission appeals the ban on advertising pharmacies to the CJEU

The European Commission has filed a complaint with the CJEU against the Polish ban on advertising pharmacies. In its current form, the ban almost completely prevents communication between the pharmacy and the patient, including information about the availability of products, facilities, pharmaceutical services or pharmaceutical care being introduced. What is standard in other EU countries is questioned in Poland. The basis for the complaint is the non-compliance of Art. 94a of the Pharmaceutical Law with the Directive on electronic commerce and art. 49 and 56 of the Treaty on the Functioning of the European Union.

TJSP's lawyers were actively involved in the proceedings before the Commission, representing entities applying to the Commission. The proceedings ended with a complaint to the Tribunal due to the existence in Poland of a provision that is incompliant with European law and anti-patient.
